That is great, at lunch a co-worker said that the invitations are up on e-bay!! Was just about to look and see! Does everyone remember The Runaway Bridge with Julia Roberts it was filmed in the State of MD on the eastern shore.

Jan, it was filmed in my hometown of Berlin! In the movie, it was named "Hale". They took the name from a hybrid peach called the "Hale Harrison Brilliant". Hale and my father were first cousins. Part of that movie (the horse scenes) was also filmed in your neck of the woods, Baltimore County.

I did not not know you were from Berlin (out side of Ocean City)! My first year of college was spent at Salisbury State back then. My girlfriend teaches Pre-K there at the school in Berlin. Small world. Do you go back often??

Jan, I still live there! But now just to the west of Ocean City only 8 miles away. I wouldn't leave the Eastern Shore for $millions! Well, maybe if I found my true love, but that ain't gonna happen, so...

I really do hope that the toast seller sues.
While this is a rather funny sort of 'product', it is simple contract law. Offer and acceptance. AND eBay is very clear on the obligation of bidders. (Any lawyers out there to add their 2 cents?)

Besides, non paying buyers on eBay are a constant problem. Perhaps a well reported lawsuit might have a chilling effect on that.

Topic: What sort of defense could the winning bidder offer to justify his refusal to pay for his win?

Could there be a valid argument that the item for sale was perishible and that the seller's intent was to construe the bidding as a joke and therefore not legitimate?

I would doubt that line of reasoning. eBay is very clear that a bid is a contract to buy. Also, the law is very clear on auctions.

I can not think of an acceptable or valid defense other than mental incapacity or perhaps too many martinis. Contract law is really rather simple & clear... unlike most law.

None the less, I would really like this guy to sue.
